PUBLIC SALES: All tax forfeited land offered at a public auction is sold to the highest bidder.
SALES OVER THE COUNTER: Parcels not sold at a public sale may be purchased after the sale by paying
the appraised value of the parcel. The appraised value (sale price) can include the value and some specials
after forfeiture and certified to date. Prices (Appraised Value plus Specials after forfeiture) cannot be
changed unless the parcel is re-appraised, or special assessments are changed by the local government, or
republished and again offered at a subsequent auction.
IMPORTANT NOTICE!!!
ALL PARCELS: Earnest Money is required to be in the form of Certified Funds. CERTIFIED FUNDS
ARE CONSIDERED THE FOLLOWING: CASHIER'S CHECKS, MONEY ORDERS OR CERTIFIED
CHECKS. PAYEE SHOULD READ AS FOLLOWS:
"HENNEPIN COUNTY TREASURER OR (your name here)"
YOU MUST FOLLOW THE ABOVE INSTRUCTIONS OR ELSE YOU WILL NOT BE ABLE TO
PARTICIPATE IN THE BIDDING PROCESS. NO EXCEPTIONS WILL BE MADE!
INTEREST RATE: The interest rate of the unpaid purchase price is a variable rate per M.S. 279.03, Subd.
1a. Approximately 30 days before annual installments are due, a billing will be mailed to indicate the amount
of the installment and accrued interest which is due. Any or all installments may be paid in advance.
FEES: Assurance fee (3% of the total sales price payable at the time of the sale).
If entering into a Contract: Contract filing fee of $46.00 will be added at time of down payment.
At the time of final payment the following fees will be added:
State Deed Fee $25.00 Deed Filing Fee $51.00
Deed Tax $1.70 for $1.00-$500 purchase price; $3.40 for $501-$1000 purchase price; .0034 times
the net consideration.
CONDITIONS: Sales are subject to existing leases, to building restrictions appearing of record at the time of
forfeiture and to easements obtained or granted by any governmental subdivision or agency thereof for any
public purpose. The appraised value does not represent a valuation basis for future taxes. Contact the city
where the land is located for details of building codes or zoning laws.
ALL PROPERTY IS SOLD "AS IS"
AND MAY NOT CONFORM TO LOCAL BUILDING AND ZONING ORDINANCES. THE COUNTY MAKES
NO WARRANTY THAT THE LAND IS "BUILDABLE". ALL SALES ARE FINAL, AND NO REFUNDS OR
EXCHANGES ARE PERMITTED.
Hennepin County is not responsible for location or determining property
lines or boundaries.
None of the following individuals (either personally or as an agent or attorney for any other person) may bid
on and purchase a parcel of tax-forfeited land unless the parcel was owned by the individual before
forfeiture: district court administrators, county auditors, treasurer, assessors or supervisors of assessments,
land commissioners or assistant land commissioners for tax-forfeited lands, or any deputies or employees of
any of the above individuals. (M.S. 282.016)
SETTLEMENT IS FINAL: It is understood that the Buyer(s) accepts the property "as is". No warranties as
to physical condition of the property subject to this purchase agreement have been made by Seller, its
Employees or Agents; any warranties of physical condition of the property are void. The Seller, its
Employees or Agents, have no further responsibility or liability with respect to the condition or management
of the property. This provision shall survive delivery of the State Deed or the Auditor's Certificate of
Purchase of Tax Forfeited Land (contract-for-deed).
Soil Conditions Vacant Land "As Is" Addendum:
Vacant Land Sold "As Is": The real property being purchased by Buyer(s) is sold "as is" and may not
conform to local building and zoning ordinances. The County makes no warranty that the land is "buildable."
Buyer(s) understands and agrees that no representations have been made regarding the real property's soil
conditions by the Seller(State of Minnesota, as Trustee; Hennepin County, on behalf of the State of
Minnesota), or the Seller's Employees or Agents.
It is understood that Buyer(s) were able to obtain authorization from Hennepin County to perform
soil testing at Buyer's own expense, before purchasing parcel or parcels. The Buyer(s) has now
purchased an interest in the property; the sale will not be rescinded if soil problems are discovered
after the sale. By signing this addendum, Buyer(s) accepts property "as is."
FURNISHING OF LABOR OR MATERIALS: Buyer shall not during the term of any contract, cause any
material to be delivered or labor to be performed without written notice to seller and lien waivers obtained.
Buyer further agrees to indemnify and hold harmless seller against all claims for labor and materials or
services made against the property covered by any contract and for the costs of enforcing this
indemnification including reasonable attorney's fees.
Any liens will constitute a default and shall result in cancellation of the Auditor's Certificate of Purchase.
HAZARDOUS MATERIALS INDEMNIFICATION: The purchaser shall indemnify Hennepin County and/or
the State of Minnesota for environmental contamination as a result of purchaser's use and occupancy of the
property.
ASSIGNMENT OF RENTS: In case of default, Seller can collect rents from tenants, without Court Order or
Appointment of a receiver and apply them to the default. ( See Page 7, Paragraph 21 of contract )
SPECIAL ASSESSMENTS: If a parcel had canceled special assessments, as indicated on the publication
list, a percentage of the purchase price will be applied to the published amount of special assessments. Any
remaining balance MAY BE REASSESSED by the municipality. Local improvements not yet assessed, and
special assessments levied after forfeiture, must be assumed by the purchaser.
IT IS THE
RESPONSIBILITY OF THE PROSPECTIVE BUYER TO CONTACT THE CITY TO DETERMINE SPECIAL
ASSESSMENTS THAT MAY HAVE BEEN CANCELED AND MAY BE SUBJECT TO REASSESSMENT,
AND THE CITY’S TERMS THEREOF.
title: The buyer will receive a Certificate of Purchase at the time of the sale and/or the Commissioner of
Revenue will issue a deed from the State of Minnesota after full payment is made. Tax forfeiture will create
a break in the chain of title.
SELLER CONVEYS TAX title and services of an attorney may be necessary
to make the title marketable.
LIENS: Most mortgages and liens except Federal and State Tax liens are canceled at forfeiture.
DEFAULT: Contracts may be canceled by the County Board of Commissioners if the purchaser defaults in
any of its terms and conditions, including, but not limited to failure to pay an installment and interest when
due, or failing to pay current taxes becoming due during the term of the contract, or code compliance is not
filed within one year after date of purchase. Upon breach by purchaser, seller may elect to declare all of the
unpaid principal and interest immediately due and payable.
All participants in the Hennepin County Tax-Forfeit Auction are hereby informed that the Hennepin County
Collection of Dishonored Checks Policy will be strictly enforced. DO NOT BID ON A PROPERTY UNLESS
YOU ARE POSITIVE YOU HAVE THE NECESSARY FUNDS AVAILABLE.
ALTERNATIVE FINANCING CONTRACT AVAILABLE: Those having religious or other prohibitions
against paying interest may choose to request the County’s Alternative Financing Contract. This contract
requires a $75 processing fee at the closing, is available only for residential property, and is available only to
people, not corporations or partnerships etc. To review the contract and discuss other benefits and
restrictions of the contract contact 612-348-3734. You should also consult your attorney and tax advisor
before entering into this contract.
FOR ALL LAND NOT IN A PLATTED SUBDIVISION: There are restrictive covenants required for marginal
lands and wetlands including lands in Auditor's Subdivisions (see Minnesota Statutes 1992, Section
103F.535, Subd. 2, and Minnesota Statutes 1992, Section 282.0185, Subd. 2.)
FORMER OWNERS: Must pay the purchase price or the amount of delinquency, whichever is more,
pursuant to Minnesota Statutes, Section 282.01, Subd. 7.
NOTE: There are other covenants and restrictions contained in the contracts.
